Terms and Conditions of Sale

The present terms and conditions are concluded between the individual business EUGENIE BAZELIS (the provider), trading under the name “kiboochan”, whose head office is located at 11 rue Marcel Sembat, Billy-Berclau (62138), registered under the identification number: 520 544 495 RM 620; and any individual or entity wishing to make a purchase through the website: http://www.kiboochan.com.

Purpose

The following terms and conditions aim to define the contractual relations between the provider and the buyer, as well as the conditions applicable to any purchase made through the website http://www.kiboochan.com.

Purchasing a product from this site implies unconditional acceptance of these terms and conditions. The confirmation click on the order has the value of an electronic signature and acceptance of the terms and conditions.

These terms and conditions will prevail over any other general or specific conditions not expressly agreed to by the provider.

The provider reserves the right to modify these terms and conditions at any time. In such cases, the applicable terms will be those in effect at the date of the buyer's order.

Characteristics of the Products Offered

The products are those listed in the catalog published on the website http://www.kiboochan.com, subject to availability.

As the products are small objects, they are fragile. The provider cannot be held responsible for any improper maintenance of the products by the buyer.

Prices

The prices listed in the catalog are in euros, exempt from VAT in accordance with Article 293 B of the French General Tax Code (CGI).

The provider reserves the right to change its prices at any time. However, the price listed in the catalog on the day of the order will be the only price applicable to the buyer.

The prices indicated do not include order processing, shipping, and delivery costs unless otherwise specified for the geographical areas detailed below.

Geographical Area

The products presented on http://www.kiboochan.com are available for Zone 1: Metropolitan France, Overseas Territories, European Union, Switzerland, and the United Kingdom.

For Zone 2: International, under conditions explained in the FAQ.

Orders

The buyer wishing to purchase a product must:

• Add their items, quantities, and desired specifications to the shopping cart,
• Verify the order,
• Add shipping costs for international orders if applicable (see FAQ),
• Confirm the order and pay via the secure Paypal platform.

Confirmation of the order will constitute acceptance of the general conditions of sale, acknowledging that you have read and agree to these terms and conditions.

The provided data and recorded validation will serve as proof of the transaction.

The provider will send an email confirmation of the completed order. If the buyer does not receive confirmation within 3 days, they may contact the seller.

Payment Terms

Payment is required at the time of order validation. No order will be shipped before payment is received.

A detailed invoice will be sent for each order, indicating the price in euros excluding VAT, in accordance with Article 293 B of the CGI, and delivery costs.

Delivery

Deliveries are made to the address provided at the time of order, which must be within the agreed geographical zone.

It is the buyer’s responsibility to ensure the accuracy of the information provided. The provider cannot be held responsible for any loss of parcels due to incorrect addresses.

Risks are transferred to the buyer once the products have left the provider’s premises.

Products are shipped in perfect condition. In case of damage during transport, a claim must be made to the carrier within three days of delivery.

Shipping times are 3 working days from receipt of payment but are indicative only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer refunded.

Shipping Costs

Items are shipped by letter or parcel with tracking and insurance.

Costs include shipping, packaging, and order processing fees. They are calculated based on the ordered items for Zone 1.

Additional costs apply for shipping sculptures internationally (Zone 2), detailed in the FAQ.

No item will be shipped by simple mail without tracking.

The buyer is responsible for any import duties.

Right of Withdrawal

The buyer, a non-professional individual, has a withdrawal period of seven days from receipt of the order to return the product to the seller for exchange or refund without penalty, except for return shipping costs.

Before returning the product, the buyer must contact the provider at contact@kiboochan.com to inform them of the return and the reasons for the decision.

The product must be returned in its original packaging and in perfect condition. Any damaged item will not be refunded.

The provider is obligated to refund the buyer within a maximum of 30 days from receipt of the return.

Warranty

All products provided by the seller are covered by the legal warranty under Articles 1641 and following of the Civil Code.

In the event of a non-conforming product, it may be returned to the seller who will exchange it or refund it in full, including return shipping costs.

All claims must be made within thirty days of delivery, by email to contact@kiboochan.com or by mail to: Bazelis Eugénie, 11 rue Marcel Sembat, 62138 Billy Berclau.

Liability

The seller is only bound by an obligation of means during the online sales process; their liability cannot be engaged for damages resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruptions, or other involuntary problems.

Intellectual Property

All elements of the site are and remain the exclusive intellectual property of the provider. No one is authorized to reproduce, exploit, redistribute, or use any elements of the site, whether software, visual, or sound, even partially, without written permission from the provider.

Personal Data

In accordance with the French law of January 6, 1978 on data protection, personal information about buyers may be subject to automated processing.

The provider reserves the right to collect information about buyers, including using cookies, but will not share this information with commercial partners.

Buyers have the right to access and rectify their data in accordance with the law of January 6, 1978.

Archiving - Proof

The provider will archive invoices on a reliable and durable medium constituting a faithful copy in accordance with Article 1348 of the Civil Code.

The provider’s computerized records will be considered as proof of communications, orders, payments, and transactions between the parties.

Dispute Resolution

These online sales terms are governed by French law. In case of dispute, jurisdiction is given to the competent courts of Paris, notwithstanding plurality of defendants or third-party claims.
