Terms and Conditions of Sale

Identification

These terms and conditions are established between the individual business EUGENIE BAZELIS (the provider), trading under the name “kiboochan”, whose head office is located at 11 rue Marcel Sembat, Billy-Berclau (62138), registered under the identification number: 520 544 495 RM 620; and any individual or entity wishing to make a purchase through the website: http://www.kiboochan.com.

Purpose

These terms and conditions define the contractual relationship between the provider and the buyer, as well as the rules applicable to any purchase made through the website http://www.kiboochan.com.

Purchasing a product from this site implies unconditional acceptance of these terms and conditions. Clicking to confirm the order constitutes an electronic signature and acceptance of the terms and conditions.

These terms and conditions prevail over any other general or specific conditions not expressly agreed to by the provider.

The provider reserves the right to modify these terms and conditions at any time. The applicable terms are those in effect on the date of the buyer's order.

Characteristics of the Products Offered

The products are those listed in the catalog on http://www.kiboochan.com, subject to availability.

As the products are small, they are fragile. The provider cannot be held responsible for improper maintenance or handling by the buyer.

Prices

Prices listed in the catalog are in euros, exempt from VAT according to Article 293 B of the French General Tax Code (CGI).

The provider reserves the right to change prices at any time. However, the price listed on the day of the order is the only price applicable to the buyer.

Prices do not include order processing, shipping, or delivery fees, unless otherwise specified for specific geographical areas.

Geographical Area

The products presented on http://www.kiboochan.com are available for Zone 1: Metropolitan France.

For Zone 2: International (all other countries), subject to the conditions explained in the FAQ.

Orders

To place an order, the buyer must:

• Add desired items to the shopping cart, specifying quantities and options,
• Verify the order,
• Add international shipping costs if applicable (see FAQ),
• Confirm the order and pay via the secure Paypal platform.

Confirming the order constitutes acceptance of the general conditions of sale and acknowledgment that the buyer has read and agrees to them.

Submitted data and recorded validation serve as proof of the transaction.

The provider will send an email confirmation of the completed order. If the buyer does not receive confirmation within three days, they may contact the seller.

Payment Terms

Payment is required when confirming the order. No order will be shipped before payment is received.

A detailed invoice will be issued for each order, indicating the price in euros excluding VAT, in accordance with Article 293 B of the CGI, and delivery costs.

Delivery

Products are delivered to the address provided at the time of order within the agreed geographical zone.

The buyer is responsible for ensuring that the address information is accurate. The provider cannot be held responsible for lost parcels due to incorrect addresses.

Risks are transferred to the buyer once the products leave the provider’s premises.

Products are shipped in perfect condition. In case of damage during transport, a claim must be filed with the carrier within three days of delivery.

Shipping times are 3 working days from payment receipt but are indicative; if delivery exceeds thirty days from the order date, the sales contract may be terminated and the buyer refunded.

Shipping Costs

Items are shipped by tracked letter or parcel with tracking and insurance.

Costs include shipping, packaging, and order processing, calculated based on ordered items for Zone 1.

Additional costs apply for shipping sculptures internationally (Zone 2), as detailed in the FAQ.

No item will be shipped by untracked mail.

The buyer is responsible for any import duties.

Right of Withdrawal

Non-professional buyers have a seven-day withdrawal period from receipt of the order to return products for exchange or refund without penalty, except for return shipping costs.

Before returning a product, the buyer must contact the provider at contact@kiboochan.com to explain the reasons for the return.

Products must be returned in their original packaging and in perfect condition. Damaged items will not be refunded.

The provider will refund the buyer within a maximum of 30 days of receiving the return.

Warranty

All products are covered by the legal warranty under Articles 1641 et seq. of the French Civil Code.

In the event of a non-conforming product, it may be returned to the seller for exchange or full refund, including return shipping costs.

All claims must be made within thirty days of delivery, by email (contact@kiboochan.com) or by mail to: Bazelis Eugénie, 11 rue Marcel Sembat, 62138 Billy Berclau.

Liability

The seller is bound only by an obligation of means during the online sale; their liability cannot be held for damages resulting from Internet use, such as data loss, intrusion, viruses, service interruptions, or other involuntary issues.

Intellectual Property

All elements of the site remain the exclusive intellectual property of the provider. No reproduction or use, even partial, is allowed without written permission.

Personal Data

In accordance with French law of January 6, 1978, personal data of buyers may be subject to automated processing.

The provider may collect information about buyers, including via cookies, but will not share it with commercial partners.

Buyers have the right to access and correct their data under the law of January 6, 1978.

Archiving - Proof

The provider will archive invoices on a reliable and durable medium, constituting a faithful copy in accordance with Article 1348 of the Civil Code.

Computerized records of the provider will be considered proof of communications, orders, payments, and transactions between the parties.

Dispute Resolution

These terms are governed by French law. In case of dispute, jurisdiction is given to the competent courts of Paris, notwithstanding multiple defendants or third-party claims.
